    That observation on the SKULL bill and masters degrees was raised by few concious and noble members of this forum before.

    Do you realize that in certain schools I know very well here, they don't even require you to take TOEFL or GRE/GMAT for grad school. Believe me, there are thousands of people in the world with $20K who would line up for such "graduate" schools and move here permanently. I am saying, any lobbying effort should be directed to tone down such bills, they are simply not very realistic at this point.

    If skill bill is passed in the same form as it is Americans will be alarmed seeing the inflow based on exemption of US based Master degree and STEM. Not only to Americans it is threat for current H1s and green card holders as well. The problem is those who have money in India can get admission in USA MS degree in any non standard college(I do not think INS can evaluate whether it is standard or not). So atleast 4 times of current MS students will come and they will get h1(I think Ms people has exemption in quota) thro Desi consultants by paying Money and get green card immeditely. This will defeat the purpose of skill bill itself. And also India so many people are doing MSC they can get gc easily here(As we know Indians or anyone will use loopholes to come here and get gc). If immigration is increased so much then it will impact all kinds of exsisting people. I think there should be control in number of h1s and also green cards. I am clear that both H1 and green card numbers should be increased but blanket exemption should not be given any category especially for H1. There were a situation on 2000 and 2001 lot of people returned India because of too much supply and Americans were angry with immigrants at that time especially H1 because they were laid off.

    So basically increase of immigration should be based on supply and demand . The purpose of Labour certification is to verify whether any american is rejected for that job. But that is now just formal and real test is not done(it is not possible to do it. If they do it it will take years to clear). I think if they double number of gcs the retrogession issue will be resolved for atleast another 5 years

    in essense...what you are saying is that if one has paystubs that one can change after the 180 day period even if 140 is not approved...

    Sanju my friend, why sarcasm ? This is such wonderful information, why can't this be made more public, posted in a prominent position on IV ? Why should members do research to get this info when it can be relatively easily acquired by Quinn Gillespie & Assoc and given to core ? Come on man, a little bit of information like this goes a long way with members.

    qasleuth, I don't believe that suri is for real. I think this guy is phony and will not spend a dime on anything other than his selfish self. I don't know why core or admins here do not give out this information, you could ask them, but I do know that folks here should grow up and be mature not scared to do their own research, because the best thing we can do for ourselves is, research and gain knowledge. I did a simple google search and within 5 minutes I found this information. So if someone wants to find information, there is no scarcity of relevant information online. The problem is, some folks don't want to move their fingers to do simple google search, but they have all the time in the world to find reasons to sit on their a$$ and not do anything. And that's just too much bull....

    Tell this suri guy to go tell his friends that the EADs they flash every time allay their anxiety is because I and others like me paid for it. So I have earned and paid for the right to sarcasm with these elite educated illiterate idiots, if you know what I mean.

    probably Texas, that is where my I-140 was approved.


    Cancelled 4 tickets and lost 1000 bucks. Was to fly on 6th. Never expected dates will move. MY PD Nov 2001 EB3 India.

    Hoping to get receipts by 20th. Is that a fair assumption? Planning to re-book for 22nd.

    Don't want to lose another dime on cancellations and re-bookings.

    Advice and share your thoughts.

    Not sure when you are planning to return to US. They will send you fingerprint notices with in a month I guess.

    Well, you assume family members can get AP and EAD after submitting I-485. Not true for many people. Take myself as an example, I was not lucky enough to file my I485 in 2007. So with a PD of early 2007, I have none of the benefit from AOS a(B) who is the beneficiary (including a spouse or child of the principal alien, if eligible to receive a visa under section 203(d) ) of--

    (i) a petition for classification under section 204 that was filed with the Attorney General on or before 2a/ April 30, 2001; or

    (ii) an application for a labor certification under section 212(a)(5)(A) that was filed pursuant to the regulations of the Secretary of Labor on or before such date; and 2a/

    t all.

    Although for me it's not a big deal because my wife will soon get her PhD and will file for her own immigration petition. This actually works better for us, because it will make the line much shorter and both of us will get the green card much quicker.

    However, for those who do not work and solely depend on their spouses to get green card. This change can spell disaster for them during the long wait caused by retrogression without the ability to file AOS.

    I am in the same boat, per INA, when your PD is current, you including your family will be able to file I485. What OP saying is that they should be counted against FB2. INA explicitly has that point.. With is we should be able to file I485 quick and primary gets GC quickly.

    I am July Filer too I have not received evn a single receipt for anything. I called USCIS they said it is taking from 90 to 120 days so wait and call.

    I had long dely in gettting my 485/EAD/AP receipts from USCIS and I wrote to my local congressman. It really worked and got the receipt numbers from congressman office.

    Try to write to your local congressman and explain your situation in one page and give them your package tracking information.

    No LUD on I-765 yet.
    LUD on I-131 again today (7/28) and the status is approved.

    Recieved by USCIS on July 11, LUD JUL 15th.

    For some postal destinations the USPS offers guaranteed 2 day service. I recently mailed a package where this service was offered. The postal worker explained that if the package was mailed on a Friday, it would be delivered on Sunday. San Francisco, CA is one of the destinations where this service is offered and the package in question was, indeed, delivered on a Sunday.

    You should check whether the postal service offers the 2-day service to the USCIS office.

    I think it is fair to go by EB level than priority date. Usually the levels mean qualifications. I think they deserve to get GC first! That makes more sense to me.

    Hello All,

    After being without job for almost 2 months, I am getting an offer for a short term project on 1099. Project is in my field and my job responsibilites are exactly same as what was approved on my labor. I am a Jul 07 filer.

    Now, if in the next few months I get any Employement Verification RFE, what are my options? How can I answer the RFE while on 1099? What kind of documentation will I need? Has anyone successfully answered an EV RFE while on 1099?

    OR

    Is being on 1099 while on EAD a bad idea and I should stay away from it?

    Related questions - I am not planning to file AC21 at this time as this is a short term contract and I don't want to 'notify' USCIS of any changes at this time. Can there be any potential issues of not filing for AC21 in such cases? My EAD will be up for renewal in Sept 2010 and I am hoping to be in a full time permanant position by then.

    Giving Pay stubs instead of FUTURE employment letter ?

    That may be a RFE and then eventually you have to give that letter and do more bargaining with your employer...

    I am clarifying myself again. I did not mean to suggest that pay stubs can be used in lieu of FUTURE employment letter.

    In any case, why not change your employer after 6 months of filing for your I-485. From the way they are treating you, you should be the first one to invoke AC21.

    I don't think you will get a RFE within 6 months, but of course you never know. But if we assume normal processing times, I am sure your new employer would give you a letter. However, do consult with an attorney before changing jobs to make sure the job is "same" or "similar".

    If you can make a concerted effort and we can ensure a large number of people will actually send the flowers, it would make a great media story. A wonderful splash on the media pages. American media will eat it up. Then get one of the IV core members to actually go on the air and explain the problem.

    It's really not a bad idea.

    Thats true there are a lot of free riders and unfortunately they actually make fun of the effort and at the same time jumps first to take the advantage.

    Free riders if you are reading this and I know you are, please and please come out of your cheap mentality and donate. You know very well that saving 20$ will not help you build a TajMahal, but donating just 20$ or 50$ will make a huge difference to millions of people INCLUDING YOU AND YOUR FAMILY.

    So don't be ashamed of yourself by not donating and donate generously.

    Not sure where you get this philosophy of encouraging people to donate by hurling insults. There is a solid proposal from realizeit which is gaining traction and many people have committed donations. Motivating people by solid proposals rather than silly insults and calls to their conscience by abusing it gets us nowhere.
