I have a couple of questions. My employer has an in-house attorney who is responsible for green card processing.
1. If i change employers WITHOUT notifying USCIS, who gets the RFE (if any) in the future? My ex-employer or beneficiary (I got my I-485 receipt directly from USCIS)
2. If i change employers WITHOUT notifying USCIS after 180 days, what happens if my ex-employer tries to CANCEL my I-140?
Can USCIS cancel I-140 without receiving any AC-21 notification from me?

I never said I'm doing any community service, I care for my green card, and I am not getting it because of the country cap. That is why country ca is my problem. But if I am able to convince a lawmaker and get something in place, while I get my Green card, thousands others will get it who are in line before me, and obviously people who are after me will move forward in line. May be with your kind of brains and temperament it is hard for you to understand, but it is simple for 60 plus people who are in our Yahoo group...

You seem to project that only you care for the issue of country-limits. I think the better description is, you only care for the removal of country limits till the day you get your green card. You do NOT want to remove country limits on EB beyond the date you receive the approval of your application. Giving a false impression to a few on this forum that temporarily removal of country limits will be easier than permanent removal of country limits is just WRONG.
After IV admin posted for the media interview few days back, I sent them an email expressing my willingness to speak with the press. I spoke with Vivek Wadhwa at length last week about this issue. Vivek Wadhwa article in Washington Post covers the issue of country limits where as his previous articles have not covered this issue.

Its disgusting that rather than working with others to fix this complicated and difficult issue, you continue to beat your own drum, without actually doing anything, but at the same time hurting the issue you claim you care for. And on top of that you want to remove the country limits only until you get your green card. Is that rationale to you in any which way?????? No. Is your action selfish????? YES.

in trouble. I am not on H1 but I think the moment you get H1, in this case COS from H4 to H1 within few months you should have paying job. There will be problem at time of extension if no paystubs are present. Bench or not employer need to Pay H1b if he has hired one.

You could be looking at the wrong Service Center for the Receipting Update.
For example, you sent your application to NSC and now, you're looking at NSC Receipting Update which tells us "July 29"....and you question, I sent my application on July 5, why until now I don't have my receipts?
The most logical answer is that if your application was sent to NSC but transferred to TSC; you should look at TSC Receipting Update which says "July 2".

Q.11 if applied for EAD before , complete below.
But there is nothing below other than your signature and date. It does not ask you of previous EAD information. What does "complete below" means?
Q.16 The Eligibility here would (c) (9) for I-485 applications correct?
Where do I mail this application . My AOS is pending at TSC.

The law does not say AOS applications should not be accepted when there are no visa numbers available, the law only says AOS cannot be approved when visa numbers are not available. USCIS internal regulations says they will not accept AOS applications when priority date is not current. by now its quite apparent that USCIS has broken a lot of there own internal regulations just to make sure the visa numbers are used up before july 2 2007. Then can easily accomodate the EAD for july filers. It all depends upon the pressure exerted on USCIS and DOS
Pitha -- the law says quite clearly that AOS applications cannot be filed if visa numbers are not available. Which is why IV was trying to get in an amendment that says AOS can be filed even when visa numbers are not available.
USCIS would fight a change in this tooth and nail -- cos as the Ombudsman has reported again and again in his annual reports -- when they spend a huge amount of time churning out EADs and APs, actual adjudications of green cards fall behind. Then there are the people (incl Ombudsman) who say that such interim benefits (EAD AP) should not be granted to such large numbers of people without security checks etc.
My guess is that this is precisely why USCIS didn't want the all current situation. They don't want to be stuck with 700K applications which have no hope of getting a greencard for years upon years, while they churn out EADs and APs for all those years.
Of course, one fix would be to increase the EAD time period to 3 yrs. Something they have been unwilling to do.
